DADS Proposed Amendments to Nursing Facility Administrators Rules

The proposed rules:

• Clarify that DADS will allow a licensee an opportunity to request an informal review before initiating proceedings to revoke or suspend a license or deny a license renewal.
• Provide the information that should be included in the DADS formal hearing notice
• Correct the timeframe a licensee has to request a formal hearing after receiving a DADS notice letter from 15 to 20 days.
• Include all the violations listed in Texas Health and Safety Code, Section 242.313, governing Sanctions, which could result in DADS imposing sanctions again a licensee.
